These Terms of Use govern your access to and use of dawkhaus.com (the “Site”), operated by Dawkhaus (“Dawkhaus,” “we,” “us”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
About the Site
The Site provides general information about Dawkhaus and our luxury vacation home management services, and a way for homeowners to contact us. Content on the Site is for general information only and does not constitute an offer, a binding quote, or financial, legal, tax or investment advice.
No guarantee of results
Statistics and descriptions on the Site, including years of experience, homes managed, revenue figures and guest ratings, describe the collective prior experience of members of our team and are provided for context. They are not a promise or guarantee of future revenue, occupancy, ratings or other results for any property. Results depend on many factors outside our control, including location, market conditions, property condition and regulation.
Inquiries do not create an agreement
Submitting an inquiry through the Site does not create a client relationship or a management agreement. Any services we provide will be governed solely by a separate written agreement signed by you and Dawkhaus. If anything in that agreement conflicts with these terms, the agreement controls.
Your information
You agree to provide accurate information when you contact us, and to submit only information you have the right to share. Our Privacy Policy explains how we handle information submitted through the Site.
Acceptable use
You agree not to:
- use the Site for any unlawful, fraudulent or harmful purpose;
- submit false, misleading or spam inquiries, or impersonate any person;
- attempt to interfere with, disrupt, overload or gain unauthorized access to the Site or its systems, or bypass its security or spam protection;
- scrape, copy or harvest content or data from the Site by automated means without our written permission.
Intellectual property
The Site and its content, including the DAWKHAUS name and logo, text, design, graphics and images, are owned by or licensed to Dawkhaus and are protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. You may not otherwise copy, modify, distribute or use them without our prior written permission.
Third-party links and services
The Site may link to third-party websites or services, such as social media or property listing platforms. We do not control and are not responsible for their content, policies or practices, and your use of them is at your own risk.
Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that its content is complete or current.
Limitation of liability
To the fullest extent permitted by law, Dawkhaus and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue or data, arising out of or related to your use of, or inability to use, the Site. Our total liability for any claim arising out of or relating to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
Indemnity
You agree to indemnify and hold harmless Dawkhaus from any claims, losses and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or your violation of these terms.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or the Site will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.
Changes to these terms
We may update these terms from time to time. When we do, we will change the effective date above. Your continued use of the Site after changes take effect means you accept the updated terms.
General
If any part of these terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver. These terms are the entire agreement between you and Dawkhaus regarding the Site.
